Morten Bergsmo
Morten Bergsmo, a European international lawyer and author, is the Director of the Centre for International Law Research and Policy (CILRAP). He has previously served as an academic in China, Europe and North-America. His writings (see list below) argue, inter alia, that
- the value or interest of ‘unity of humankind’ should be given a further measure of recognition also by international criminal law;
- international courts and organisations cannot fulfil their mandates unless their high officials uphold the legally-binding integrity standard, which States Parties should regularly affirm;
- contemporary quasi-hegemonic practices in international justice should be replaced by more genuinely global approaches;
- States Parties should govern the International Criminal Court more incisively, drawing on experienced experts in domestic judicial or prosecutorial administrations, on a continuous – not rotation – basis;
- calls to externalise justice should not be at the expense of the strengthening of domestic justice capacity and will in the country concerned;
- case-prioritization should be informed by thoughtful criteria, including representativity, without affording the same priority to grave and less grave crimes (as imposing such moral equivalence through misconceived ‘positive even-handedness’ undermines trust in the prosecution);
- religious leaders should use a broader spectrum of more effective measures to prevent or reduce hate speech by their members or in the name of their community or faith (supplementing the human-rights based approach); and that
- peace and reconciliation diplomacy – battered by religious hatred, dissimulation and denial – should not inadvertently prolong oppressive regimes.
Through his institutional service, research and writing, he has coined several concepts that have become commonplace in contemporary international criminal law and justice, such as 'positive complementarity', 'impunity gap', 'thematic prosecution', 'military self-interest in accountability', 'fact-work', and ‘integrity in international justice’. He conceptualised and led the five-volume project 'Historical Origins of International Criminal Law', the four-volume ‘Quality Control Project’, and the three-volume ‘Philosophical Foundations of International Criminal Law’ project.
Formerly, Bergsmo served academically as Visiting Professor, Peking University Law School (2012-18) and Georgetown University (2010-12); Fernand Braudel Senior Fellow, European University Institute (2011 Spring); Visiting Fellow, Stanford University (2010-13); Visiting Scholar, UC Berkeley (2010 Spring); Researcher, University of Oslo (2010-12); and Senior Researcher, PRIO (2006-09) – all to gain relevant experience to build an autonomous CILRAP. He was consistently ranked among the top teachers at the universities where he taught, and has lectured extensively around the world. He has practiced as Special Adviser to the Office of the Director of Public Prosecution of Norway (2007-08); Senior Legal Adviser and Chief of the Legal Advisory Section, Office of the Prosecutor of the International Criminal Court (ICC) (2002-05); Co-ordinator of the establishment of the ICC Office of the Prosecutor (2002-03); Legal Adviser, International Criminal Tribunal for the former Yugoslavia (ICTY) (1994-2002); and Legal Adviser, UN Commission of Experts for the Former Yugoslavia established pursuant to Security Council resolution 780 (1992) (1993-94). He represented the ICTY to the UN negotiation process to establish the ICC (1996-2002), and has extensive multilateral and international organizations experience. He has advised peace processes, the European Commission, several governments, and the Nobel Committee.
Bergsmo has pioneered the equalisation of access to international law, arguing that access should be open to increase professional quality and empowerment, and to broaden discourse communities. To serve this policy objective, he has created the ICC Legal Tools Database (which was granted the 2023 Jus Gentium Research Award by the American Society of International Law), Case Matrix (for which he received the 2008 Dieter Meurer Prize for Legal Informatics together with Ralph Hecksteden), and Lexsitus – services that enjoy millions of hits by thousands of users from around the world and have inspired the creation of other software – and founded CILRAP’s CMN and the Torkel Opsahl Academic EPublisher (TOAEP), the first open-access publisher of its kind in international law. Both Lexsitus and TOAEP have been certified by the Digital Public Goods Alliance as digital public goods. Through various CILRAP activities and his personal example since 2012, he has urged a greater engagement with international law capacity in China and India.
Bergsmo has three children, descends from an old Norwegian family, and has his base in Florence, two blocks from the CILRAP Bottega. He has worked or studied in Beijing, Cambridge, Copenhagen, Florence, Geneva, Haifa, London, New York, Prague, Oslo, Stanford, The Hague and Washington, DC. He is occasionally on X @MortenBergsmo.
